NOTICE OF TRUSTEE'S SALE

WHEREAS, BOYCE HAWES and BRENDA HAWES, by their Deed of Trust dated January 6, 2012, and recorded in the Recorder's Office of Barton County, Missouri in Book 2012, at Page 55, conveyed to JAMES V. NICHOLS, Trustee, the following described real estate, situated in the County of Barton State of Missouri, to-wit:

A tract commencing at the Northwest Corner of Northwest Quarter of Southeast Quarter of Section Twenty-nine (29), Township Thirty-two (32), Range Thirty (30), and running thence East 319 feet, thence South 250 feet, thence West 319 feet to the center of the road, thence North along the center line of said road 250 feet to the place of beginning, EXCEPT a tract commencing at the Northwest Corner of Northwest Quarter of Southeast Quarter of said Section 29, running thence East 155 feet, thence South 250 feet, thence West 155 feet to the center of the road, thence North along the center line of said road 250 feet to the place of beginning, ALSO EXCEPT that part taken for road purposes.

And

A tract of land being located in Lot 7 of Block 46, Parry's 3rd Addition to the City of Lamar, Barton County, Missouri and the East ½ of vacated alley as per Order of Council Bill Number 1692, Ordinance 1679 and recorded as document #2007-623 dated April 17, 2007, being described as follows: Beginning at the Northeast corner of said Lot 7, Block 46, thence S02°29'08"W along the East line of said Lot 7, Block 46, a distance of 71.00 feet, thence N88°04'47"W a distance of 91.40 feet, thence N02°29'08"E a distance of 18.70 feet, thence N88°04'47"W a distance of 65.60 feet to the Centerline of said Vacated Alley; thence N02°29'08"E along said Centerline a distance of 52.73 feet, thence S87°55'02"E along the North line of said Lot 7, Block 46, a distance of 157.00 feet to the point of beginning; and

which conveyance was made to James V. Nichols, Trustee, in trust, to secure the payment of the promissory note in said Deed of Trust described; and WHEREAS, due to the inability of James V. Nichols to act, Stephen Tanner, the holder of said Deed of Trust and Grantor under the Appointment of Successor Trustee by Mortgagee has appointed Successor Trustee, MARIANN MORGAN.
WHEREAS, default was made and still continues in the payment of said note and the whole amount has become due and payable.

NOW, THEREFORE, at the request of the legal holder of said note, I, Mariann Morgan, the undersigned Successor Trustee, will sell the property above described at public vendue, to the highest bidder for cash, at the West front door of the Barton County Courthouse in the City of Lamar County of Barton State of Missouri, on Thursday the 13th day of January, 2022 between the hours of 9:00 a.m. and 5:00 p.m., (more particularly 1:00 p.m.) for the purpose of satisfying said indebtedness and the costs of executing this trust.
